A new lawsuit is expected in the United States District Court for the District of Columbia over an alleged conspiracy between the pharmaceutical industry and the Food and Drug Administration.
The lawsuit, filed Friday in the U. S. District Court for the District of Columbia, alleged that the company had engaged in “coercive” sales and marketing of an anti-estrogen drug to market a generic version of the popular drug Tamoxifen. A federal court jury later found in favour of the plaintiffs, who also claimed that the company’s marketing and sales practices led to a conspiracy between the drug maker and the FDA.
The suit, filed in the Eastern District of Pennsylvania, claims that the company had engaged in “coercive” sales and marketing of an anti-estrogen drug, “the Nolvadex brand” (the generic name for Tamoxifen), to a product called Nolvadex (tamoxifen). The suit also claims that the company’s marketing of the drug in the United States was illegal and promoted a “false” and misleading representation of the FDA.
The FDA approved Nolvadex in the United States for sale under the brand name Nolvadex. It was a generic version of the drug and it has not been approved for sale in the United States.
The lawsuit is part of a joint effort between the U. Food and Drug Administration (FDA) and the pharmaceutical industry to resolve the investigation into the drug maker’s alleged marketing and sales of the drug.

The company paid a co-payment of $50,000 to resolve the allegations against it, according to the suit.
“We believe the allegations that Novo-Dart marketed and sold Novo-Dart’s own generic version of the drug and promoted the drug in the United States were false and misleading.”
